Summary: | Local Administrations, Places of Worship and Administrative Discretion : Reflections on the Controversial Case of the Mosque of Pisa · The premise of this paper is the development of religiosity as a collective phenomenon. The latter includes the identification of a space dedicated to the celebration of worship by the religious community. In this perspective, it is the duty of institutions, whether international, European or national, to guarantee the existence of sacred spaces for religious groups. The core of the discussion and the best test case is represented by the Islamic confession and the lawsuit for the construction of a mosque in the city of Pisa : the latter is indeed a useful case to examine how Italian institutions deal with those crucial issues concerning the right to build sacred places for non-recognised and non-institutionalised religious groups. n particular, the study aims to shed new light on the issues related to the exercise of iscretionary powers by local authorities responsible for applying regional discipline in the field of town planning. This aspect reveals a very flexible use of discretionary powers by local administrations, which have the power to include or exclude the presence of non-Catholic religious groups from municipal boundaries. Finally, the international, European and Italian legislation on the right to create sacred spaces is analysed. To this end, the legal instruments available to regulate relations between the Italian State and religious denominations (other than the Catholic Church) are assessed, while the problems raised by the case of the Mosque in Pisa are examined and highlighted 1.
