Résumé: | The islamic cultural associationism before (perhaps) the European Court of Human Rights : An endless story · The essay retraces the tangled litigation between the Assalam cultural association of Cantù and the administration of the same municipality, which has long engaged the Italian administrative courts regarding the use of a building owned by the association as a cultural meeting/worship place. This paper dwells on the reconstruction of the judicial case in order to highlight the potential violations of the echr provisions, on the basis of the plaintiffs’ claims. The investigation begins with analyzing the actual possibility for the association to defend the interests of its members (Art. 34 echr) with regard to the allegd violation of Art. 9 echr, and thus focuses on the applicant legal status. Should the Strasbourg Court decide to uphold the appeal, the possible violation of Arts. 9 and 14 echr and Art. 1 of Protocol No. 1 annexed to he echr will be examined in order to pinpoint the most problematic issues and then uggest some solutions that could bring the Islamic associations out of the current situation of opacity. 1.
