Résumé:A prominent Catholic physician has not only taken a pro-choice stance publicly, but she works in an abortion clinic and admits that she peifonns abortions. The diocesan bishop feels that he must counteract the scandal caused among the faithful and would like to declare that she has incurred the latae sententiae excommunication prescribed in canon 1398. However the bishop wonders if he can do this because of the norm found in canon 1425, §1, 2 °.
