Summary: | The appearance of new technologies has had its impact on the new economy, and this has been also translated into a change in the labor relations. This paper analyzes the legislation that regulates the employment relationships of people working through digital labor platforms, focusing on food delivery workers, or also called "riders." On the one hand, the article analyzes different decisions and judicial rulings that allow progress in Spanish legislation in this area, giving birth to the "Rider Law", and on the other hand, analyzes the European proposal for a Directive on improving working conditions in platform work, also carrying out a comparative study between different legislations, highlighting the comparison with Italian legislation and analyzing the impact on the different legal systems of the possible transposition of this proposal for a directive El avance de las nuevas tecnologías ha tenido su impacto en la economía y a su vez, como no podía ser de otro modo, esto se ve traducido en un giro en el ámbito de las laborales. Este artículo analiza legislación que regula las relaciones de trabajo de los trabajadores de plataformas digitales centrándose en los repartidores de comida a domicilio o también denominados “riders”. De una parte el articulo analiza diferentes decisiones y sentencias judiciales que permiten un avance en la legislación española en este ámbito dando nacimiento a la “Ley rider”, y por otra, se realiza una análisis de la propuesta de directiva europea relativa a la mejora de las condiciones laborales en el trabajo en plataformas digitales realizando además un estudio comparado entre diferentes legislaciones destacando la comparación con la legislación italiana y analizando el impacto en los diferentes ordenamientos jurídicos de la posible trasposición de esta futura directiva. |
