Description
Summary:This article focuses on current developments in canon law. Because it concerns many aspects of ecclesial experience and impacts the Codex Iuris Canonici, the frenetic rate of legislative production not infrequently leads to problems of coordination and systematic rationalization, prompting in turn various recent issues that may have significant consequences for legal certainty in the Church. In light of this complex situation, we retrace some considerations by authoritative scholars from two decades before the Second World War, who compared legal certainty in the secular legal systems of their time with the absolutely specific - and irreducible to the latter - legal certainty proper to the ecclesial legal system. The purpose is to ask whether such reflections, though strictly linked to the historical context in which they were formulated, may also serve as a source of inspiration in relation to the impasse in which canon law currently finds itself.
