| Résumé: | Tenuto conto della riforma del diritto penale nel Codice del 1983, avvenuta con la Costituzione apostolica Pascite gregem Dei del 23 maggio 2021, si cercherà di confrontare il Titolo III De delictis contra sacramenta del nuovo Libro VI del CIC, Parte II, e il Capitolo II De poenis in singula delicta del Titolo XXVII del Codice dei Canoni delle Chiese Orientali, proponendo anche una revisione di quest'ultimo per poter abbracciare le nuove forme delittuose, in modo particolare nella celebrazione dei sacramenti, anche nel diritto orientale. La pena non è incompatibile con la carità che dovrà esercitare l'autorità competente, che vale sia in Occidente sia in Oriente. Taking into account the reform of penal law in the 1983 Code which took place with the apostolic constitution Pascite gregem Dei of 23 May 2021, an attempt will be made to compare Title III De delictis contra sacramenta of the new Book VI of the CIC, Part II, and Chapter II De poenis in singula delicta of Title XXVII of the Code of Canons of the Eastern Churches, also proposing a revision of the latter in order to include new criminal behaviour, especially in the celebration of the sacraments, also in Eastern law. The penalty is not incompatible with the principle of charity to be applied by the competent authority both in the West and in the East. |
