L’influence dominicaine sur le droit savant au 13e siècle est pourtant peu étudiée par l’historiographie. Elle est ici abordée à travers trois thèmes : la dimension juridique des sommes de confesseurs ; l’influence dominicaine sur les théories juridiques ; la présence éventuelle d’un enseignement du droit dans les studia dominicains. The Dominican order emerged during a century that saw the institutionalization of the science of law and a wide diffusion of learned legal concepts within the Church. The Dominican influence on learned law in the 13th century is however little studied by historiography. It is addressed here through three themes: the juridical dimension of the Sums of confessors; the Dominican influence on juridical theories; and the possible presence of a teaching of law in the Dominican studia. |
