Il presente articolo approfondisce il significato di questa disposizione, riproponendo la dottrina classica dell’equità, elaborata da legisti e canonisti e arricchita dalle riflessioni di San Tommaso d’Aquino. L’aequum viene colto dallo sguardo attento di una conscientia a iure informata. L’equità spinge l’operatore del diritto a prendere in considerazione quanto lo possa aiutare a formulare un giudizio adeguato alla realtà giuridica. |
