Summary: | In March of 2021, a sole judge in a marriage case issued an affirmative decision on the ground of grave lack of discretionary judgement, in accord with canon 1095 §2 on the part of both the Respondent and the Petitioner. The Husband Respondent, in a timely manner, appealed the first instance decision directly to the Roman Rota. Nearly two years later, the Rota issued a decree in which the turnus determined that the appeal if the Respondent was manifestly dilatory, in accord with Canon 1680 §2, regarding himself and the Woman Petitioner. The Rota confirmed the first instance sentence by decree. Included here is the unofficial English translation by the recipient Sole Judge, printed with permission of the Dean of the Roman ROta. References to the Acta were retained (without specific page numbers) to demonstrate the meticulous and careful way that the Father Auditors of the Turnus studied and cited the body of evidence in making its decision. |
