| Summary: | Sintetizando su desarrollo postconciliar, las cuestiones más importantes sobre el matrimonio canónico a la luz del Vaticano II han tenido que ver con la estructura esencial del matrimonio (su estructura natural –es decir, “communio vitae”; “amor coniugalis”, y “bonum coniugum”–; y su estructura sacramental con la cuestión de la inseparabilidad entre contrato y sacramento), con la dimensión sexuada de la pareja (impedimento de impotencia masculina, la cópula consumativa del matrimonio –humano modo y miedo– y el tratamiento jurisprudencial de las desviaciones sexuales) y con el consentimiento matrimonial (incapacidad; error facti, iuris y dolosus; y las exclusiones). Algunos de estos puntos indican las perspectivas que pueden adivinarse para el futuro. Summarizing its development after Vatican II, the most important questions on the canonical marriage in the light of the Council have had to see with the essential structure of the marriage (its natural structure, “communio vitae”; “amor coniugalis” y “bonum coniugum”; and its sacramental structure with the question of the inseparability between contract and sacrament), with the sexuality of the couple (impediment of masculine impotence, consummative conjugal act – human fashion and fear – and jurisprudential treatment of the sexual deviations) and with the matrimonial consent (incapability; error facti, iuris and dolosus; and the exclusions). Some of these points indicate the perspectives that can be supposed for the future. |
