Summary:This paper deals with the canonical nature of the exarchates erected for giving pastoral care to all the faithful of Byzantine tradition domiciled in a given territory. Here, the key questions are whether this kind of ecclesiastical circumscription can exist without referring to a specific Church sui iuris among the various ones of Byzantine tradition, and whether it could eventually become a new Church sui iuris itself. The study begins offering the facts: how many of this kind of exarchate do exist, the specific historical circumstances of their erection, etc. A reflection on these facts follows. If the erection of the exarchate is addressed to the Byzantine faithful “residing in” the country, then it seems clear that it is a multi-ecclesial circumscription. But if it is addressed to the Byzantines “of” the country it could be understood as belonging to the Church sui iuris of the people of that nation, ethnically and linguistically considered. Yet, the present social situation of many countries, with people with full citizenship but with diverse ethnical origin, postulates to include every Byzantine “of” that country into the exarchate. The answer to the question about the possibility that an exarchate of this kind become a new Church sui iuris depends on the nature and scope of the Church sui iuris. A Church sui iuris is justified for giving pastoral care to a specific “people”. So, it could be created only if the community of faithful of Byzantine tradition, originally belonging to different “nations”, eventually acquires the awareness of being one distinct people. As a digression, the author opines that it would be advisable to enlarge the concept of exarchate in order to really include all the major ecclesiastical circumscriptions that are not eparchies, even complementary structures such as Military Ordinariates, Personal Prelatures, Ordinariates for Oriental faithful, etc.
