Resumo:This study, updated by recent documented contributions (cf. Fan-tappie 2008), confirms the doctrinal interpretation that understands the CIC of 1917 not as a "code" in the modern sense-characterized first of all by the rupture with the former system of juridical sourc-es-but rather a "consolidation" of ancient and classic canon law (cf. Gherri 2003). Tue study illustrates that the "code" as an instrument radically conditioned the arrangement of the "ordinamento giuridico" from the 20th century and the conception of law through the prevalence given to the law (= the code). This, however, does not compromise the survival (as a juridical source) of the sui iuris Eastern Churches' law, both ancient and, above all, traditional. On the contrary, Vatican II asks for consolidation through the "collection" and the organization of the ius proprium of each.
