Resumo:The Magisterium of the Church officially acknowledges human rights as based in the very dignity of the human person as such. The question still remains, which are the consequences of this acknowledgement "ad extra" for the law of the Church "ad intra": Are the human rights of immediate juridical validity in canon law, or do they need to be transformed into it, in order to become valid? Or are they a subject matter of the society "extra Ecclesiam" only and therefore are to be dealt with in the Catholic Social Doctrine instead of being an issue of canon law? The analysis considers the notion of "human rights", tries to point out the relevance and significance of the "human dignity" for the legal order of the Church; draws some conclusions from the results of the analysis and intends to give basic criteria regarding the problem, if and under which conditions human rights are juridically binding within the Church and her law.
Das Lehramt der Kirche anerkennt die Menschenrechte als in der Würde der menschlichen Person selbst begründet. Daraus ergibt sich die Frage, was die Anerkennung "ad extra" für die Rechtsordnung der Kirche "ad intra" bedeutet: Gelten die Menschenrechte daher "eo ipso" auch im kanonischen Recht oder müssen sie dorthin transformiert werden oder sind sie eine Kategorie allein "extra Ecclesiam" und somit nicht des kanonischen Rechts, sondern der katholischen Soziallehre? Die Untersuchung geht vom Begriff der Menschenrechte aus, versucht die Relevanz der Menschenwürde für die Rechtsordnung der Kirche aufzuzeigen, die Konsequenzen aus den gewonnenen Erkenntnissen zu ziehen und grundlegende Kriterien anzugeben, nach denen die Geltung der Menschenrechte in der Kirche zu beurteilen ist.
