| Résumé: | El M.p. “Mitis Iudex Dominus Iesus” ha introducido importantes cambios en el proceso de nulidad matrimonial en la Iglesia latina, con miras a determinar la nulidad o validez del vínculo matrimonial de modo ágil y más accesible. El autor de este artículo se detiene en la nueva dinámica del proceso, concretamente, en la determinación de la fórmula de las dudas a cargo del vicario judicial para los tres tipos de procesos. Esta importante modificación plantea algunas cuestiones prácticas al momento de aplicarlo, sea en ámbito diocesano como ante la Rota Romana. The M.p. “Mitis Iudex Dominus Iesus” has introduced significant modifications to the marriage nullity process for the Latin Church, in order to declare the nullity or validity of the marriage in a more accessible and less time-consuming way. The author of this work has focused on the new process dynamic, specifically, on the formula of doubt run by the judicial vicar for the three type of processes. This important modification raises some practical questions when this norm is applied whether in the diocesan tribunal or the Roman Rota. |
