| Summary: | In the case of ecclesiastical goods it is true that "the ends justify the means". It is in fact the purposes - those typical of the Church in general - that explain the existence and use of the goods and activities connected to the reality of the Church. This study explores in depth the finalities of ecclesiastical goods as presented by can. 1254 and in their relationship with the Conciliar fonts upon which the Code is based, and seeks to show how the reference to these Conciliar sources becomes decisive for the various activities connected with ecclesiastical goods, beginning with their acquisition (even when freely given) by ecclesial subjects. Canonical patrimonial law is therefore to be understood as an effective protection of the ecclesiality of temporal goods. Nel caso dei beni ecclesiastici è vero che "i fini giustificano i mezzi". Sono infatti le finalità - quelle tipiche della Chiesa in generale - ciò che dà ragione dell'esistenza e dell'utilizzo dei beni e delle attività connesse nella realtà ecclesiale. Lo studio approfondisce le finalità dei beni ecclesiastici presentate dal can. 1254, anche nel loro rapporto con le fonti conciliari della disposizione codiciale, e cerca di mostrare come il riferimento a esse diventa decisivo per le varie attività connesse ai beni, a cominciare dalla stessa loro acquisizione (anche a titolo gratuito) da parte di soggetti ecclesiali. I1 diritto patrimoniale carionico va quindi inteso come un'effettiva tutela dell'ecclesialità dei beni. |
