| Σύνοψη: | La teología y el derecho canónico tienen mucho en común, y entre ellas no es infrecuente algún grado de incomprensión mutua. Los teólogos recelan de una excesiva juridización de la realidad cristiana por parte de los canonistas. Estos a su vez desconfían de una “pastoralidad” en la interpretación de las normas por parte de los teólogos que acabe afectando a la justicia y a los derechos de los fieles. El autor examina la cuestión desde el punto de vista teológico y considera críticamente cuatro aspectos que afectan tanto a la teología como al derecho canónico: el objeto, la sistematicidad, la normatividad y el principio de autonomía. Plantea finalmente un posible punto de encuentro de la teología y del derecho canónico en el modo de entender la salus animarum. While theology and canon law have much in common, some degree of mutual misunderstanding is not unheard of. Theologians are wary of excessively legalistic approaches to Christian reality among canon lawyers. The latter, in turn, are suspicious of ‘pastoral sensitivities’ in the interpretation of laws by theologians, which may compromise justice or the rights of the faithful. This article explores the issues from a theological point of view and reflects critically on four aspects that affect both theology and canon law: object, systematicity, normativity and the principle of autonomy. Finally, it presents a potential intersection point for theology and canon law in how salus animarum is understood. |
