Summary:At the request of our bishop, a priest in our diocese submitted his resignation to the bishop from his office as pastor in writing. The bishop verbally accepted the resignation and shortly thereafter appointed a new pastor to the parish. The bishop also announced the resignation in the local media. The original pastor is now attempting to retract his resignation, claiming that he has received no written acceptance from the bishop. Because the Code of Canon Law does not explicitly state that the resignation must be accepted in writing, the bishop contends that his acceptance was valid when he verbally and publicly informed the pastor of the acceptance. The bishop also argues that his appointment of the new pastor is valid. ls the acceptance of the resignation valid and effective? Does the priest have a right to appeal the bishop's actions?
