| Итог: | Este artículo estudia los delitos de pornografía infantil y posesión de pornografía infantil en el contexto del ordenamiento penal del Vaticano. A partir de la conexión entre pedofilia y pornografía infantil, el estudio se centra en analizar las diferencias entre estos dos tipos de delitos, para identificar las características definitorias de cada uno. También se destaca la diferencia entre pornografía infantil y pornografía de menores. Una lectura atenta de las leyes que constituyen el Código Zanardelli revela sus limitaciones, esto es, la imposibilidad de probar o sancionar nuevos casos penales. Así, el Legislador procedió a actualizar y adaptar el derecho penal con una serie de medidas, diseñadas para permitir que el ordenamiento del Vaticano satisfaga las necesidades emergentes en relación con nuevos tipos de delitos. La sección final del documento explora la evolución de la respuesta regulatoria del Vaticano a los delitos de pornografía infantil y posesión de pornografía infantil. This article studies the crimes of child pornography and possession of child pornography in the context of the Vatican criminal law system. Starting from the connection between pedophilia and child pornography, the study focuses on the analysis of the differences between these two types of crime in order to identify the defining characteristics of each. The difference between child pornography and pornography of minors was also highlighted. A close reading of the laws comprising the Zanardelli Code discloses its limitations, an inability to prove or punish new criminal cases. Thus, the legislative body proceeded to update and adapt the criminal law with a range of measures designed to enable the Vatican system meet emerging needs in relation to new types of crime. The final section of the paper explores the evolving Vatican regulatory response to the crimes of child pornography and possession of child pornography. |
