| Summary: | Facendo tesoro degli apporti dei filosofi del diritto Villey, Cotta e Hervada, si distingue la realtà del diritto inteso come il suum dovuto, oggetto della virtù della giustizia, dalla norma giuridica intesa come regola della condotta giusta. Si analizzano le nozioni di ius e di norma e poi si studia il rapporto tra la norma e il diritto, cercando di individuare soprattutto i collegamenti di causalità. L’articolo finisce con alcune considerazioni circa la conoscenza della norma in ordine all’individuazione dello ius. Taking advantage of the contributions of the juridical philosophers Villey, Cotta and Hervada enables the distinction of the ius intended as the owed suum, object of the virtue of justice, from the juridical norm understood as a rule of right conduct. This article analyzes the notions of ius and norm, proceeding to study the relationship between the norm and the right (ius), with the aim of identifying, primarily, the links of causality. The article concludes with some considerations about the knowledge of the norm with regard to the identification of the ius. |
