| Whakarāpopototanga: | In un contesto normativo ed ermeneutico, orientato a conseguire i vantaggi offerti dalla moderna tecnica della codificazione, forse nessuna norma può offrire elementi utili a valutare l'effettiva interazione tra metodo codificatorio e dinamiche ordinamentali tipicamente canonistiche, quanto quella preordinata a rispondere al più grosso problema che ogni codificatore ha dinnanzi a sé, e cioè quello delle lacune del sistema. In tale prospettiva, l'indagine circa il processo di formazionc del canone 20 del Codice piobenedettino intende offrire qualche elemento utile per rispondere all'interrogativo cruciale: è il Codice che ha cambiato il diritto canonico o il diritto canonico che ha cambiato il Codice? In a normative and hermeneutic context, aiming at achieving the benefits offered by the modern art of codification, no regulation may perhaps give elements to evaluate the real interaction between codifying approach \ method and typically canonistic dynamics better than the one which is focused on solving the biggest problem that each codifier has to face, namely the one connected to the system's lacunas. In this perspective, the research into the formation process of canon 20 in the Pio,Benedectine Code intends to offer some useful elements to answer the crucial question: is the Code which has changed the Canon Law or is the Canon Law that has changed the Code? |
