| Zusammenfassung: | L' articolo s' interroga sulla possibilità di conciliare le tradizioni giuridiche orientali con l'idea del " Codice moderno". L'adattabilità della tecnica "codificatoria" alla disciplina orientale dipende da diversi fattori, anzitutto dai presupposti filosofico-giuridici sottesi all'idea di Codice e dalla sua elasticità. Inoltre, come conciliare l'idea di un "Codice unico" per tutte le Chiese orientali con la varietà caratterizzante il patrimonio disciplinare dell'Oriente? Infine l'autore propone una valutazione critica dell'indole orientale del CCE0'90. The article explores the possibility of reconciling Eastern legal traditions with the idea of a "Modern Code". The adaptability of the technique of the codification to oriental discipline depends on several factors, first of all the implicit philosophical-juridical assumptions of the codification and its elasticity. In addition, the author asks how to reconcile the idea of a " Unique Code" for all Eastem Churches with the variety characterizing the disciplinary heritage of the Orient? Lastly, the author proposes a critical evaluation of the oriental canonical specificity of the CCE0'90. |
