| Résumé: | Die Frage nach dem Verhältnis von Barmherzigkeit und Recht hat nicht nur theoretische, sondern praktische Bedeutung. Der Beitrag zeigt, wie Barmherzigkeit aus rechtstheologischer Sicht als genuines Thema betrachtet werden soll, das dem Recht im Handeln der Kirche den ihm zustehenden Stellenwert und Ort einräumt. Aus der Perspektive des Rechts geht der Artikel auf den Anwendungsbereich der Barmherzigkeit in Bezug auf das Recht ein, beantwortet die Frage "Wo berührt die Barmherzigkeit überhaupt das Recht?" und versucht abschließend die gewonnenen Ergebnisse auf die Zulassung geschiedener Wiederverheirateter zu den Sakramenten anzuwenden. The question of the relationship between mercy and the law has both a theoretical and a practical significance. This essay demonstrates from a canon-law perspective how mercy ought to be considered as a genuine theme, one which affords the law its due place and status in the activity of the Church. Starting from the perspective of canon law, the article considers the ambitof mercy within the law and responds to the question, "Where actually do mercy and the law meet?" The answers that arise are applied to the question of permitting the divorced to sacraments. |
