| Summary: | The Exceptiones Petri legum Romanorum , a treatise on Roman law, were composed in the early twelfth century in Provence; codex MS Lleida Arxiù Capitular RC_0021 is a particularly significant manuscript of the treatise. As this article shows it is its oldest extant copy and il luminates authorship, origin and date of the work, all points that have been hotly debated until now. After a short introduction the paper discusses in its second part the historiography of the Exceptiones Petri in connection with the Lleida manuscript. The third section addresses the date of this treatise, while the fourth turns to the glosses in the Lleida manuscript before presenting conclusions in a final section. Appendix I to this paper transcribes the glosses in the Lleida manu- script in comparison to other manuscripts of the Exceptiones . For the sake of convenience Ap pendix II lists all the references to Gratian's Decretum that are missing in the Lleida manuscript, but are found in all younger manuscripts of the Exceptiones and were accordingly published by Fitting and Mor. Die Exceptiones Petri legum Romanorum, ein Werk zum römischen Recht, entstanden im frühen 12. Jahrhundert. Sie sind insbesondere überliefert durch den Codex Lleida Arxiù Capitu lar RC_0021. Dieses Manuskript, wie in diesem Beitrag gezeigt wird, ist die älteste Überliefe rungsstufe des Werkes. Damit wird es möglich, Autorschaft, Ursprung und Entstehungszeit des Buches präziser zu bestimmen. Nach einer kurzen Einleitung gibt der Beitrag in seinem zweiten Abschnitt einen Überblick zur Forschungsgeschichte der Exceptiones Petri und zur Rolle des Manuskripts von Lleida hierin. Im dritten Abschnitt wird nach dem Entstehungszeitpunkt des Werkes gefragt, während der nachfolgende vierte Abschnitt sich den Glossen in der Handschrift von Lleida zuwendet. Der Schlussteil zieht Bilanz aus den so gewonnenen Befunden. Appendix I dieses Beitrags untersucht die Glossen der Handschrift von Lleida im Vergleich insbesondere zu anderen Überlieferungsträgern der Exceptiones . Appendix II listet die Verweise auf Gratian auf, die im Manuskript von Lleida völlig fehlen, sich aber in anderen späteren Manuskripten der Exceptiones finden und von Fitting und Mor ediert wurden |
