| Summary: | The Tribunal of the Roman Rota has responded to the preliminary question posed regarding whether the appointment of a delegated judge ad casum by a diocesan bishop entails the nullity of the judgment issued by the tribunal. The arguments in favor of this position claim that, because the judge was not appointed in advance by law, a condition guaranteed by all secular legal systems that protect the rights inherent to human dignity, the trial must be seen as unfair. The response of the Roman Rota affirms the bishop’s power to delegate ad casum. The perspective presented here is that a systematic interpretation that takes into account the fundamental rights guaranteeing respect for human dignity in the canonical order should lead to the conclusion that the possibility of delegating judicial power should never be ad casum and after the facts of the trial, especially in the case of criminal proceedings. |
