The method followed has been that of investigating the sources of the Chilean Civil Code on this matter, for which a relevant starting point is Bello's notes to the 1853 Project. The study provides evidence that the hypothetical causality schemes introduced in the Chilean Civil Code have an origin in the work of Joseph Pothier and, through this author, became relevant certain passages of the Digest, precisely those that allow establishing accurately the set of assumptions contained in said schemes. | ||

El objetivo del trabajo es examinar la historia dogmática de dos preceptos del Código civil chileno, los artículos 1672 y 1676, en cuanto en ellos se observa la formulación de esquemas de causalidad hipotética en relación con los efectos de la pérdida de la cosa debida. El método observado ha sido el del examen delas fuentes del Código civil chileno en esta materia, para todo lo cual un punto de partida relevante son las notas de Bello al Proyecto de 1853.
