| Resumo: | This research deals with the regulation of the ecological crime in the Spanish legal system and, at the same time, the position of the Magisterium of the Church regarding the ecological issue. Thus, attending to the normative antecedents - from the most remote to the closest - that have made possible the defense of the environment from the penal order, the complicated inclusion and determination of the penal type will be made clear, overcoming the anthropocentric conception and articulating a mechanism of penal protection that develops art. 45 of the EC and its future projection from the theological point of view. La protección de la naturaleza ha sido siempre objeto de preocupación por el legislador, tal y como queda reflejado en el artículo 45 de la Constitución Española. No obstante, la defensa del medioambiente -desde el punto de vista jurídico-no ha obtenido una respuesta unánime y se ha visto en la necesidad de conciliar posturas que abogan por la consagración de los llamados ‘Derechos de la Naturaleza’. Esta concepción presenta el cambio de la visión antropocéntrica a una visión ecocéntrica del bien jurídico protegido medioambiente, tal y como se pone de manifiesto en la Laudato si’, convirtiéndose dicha postura en un pilar fundamental a la hora de tipificar los delitos contra el medioambiente en la actualidad siguiendo el mandato de nuestra norma fundamental.Por todo ello, la presente investigación tiene como objetivo el estudio del delito ecológico en el Código Penal Español y averiguar en qué medida recoge las recientes posturas ecocéntricas que defienden, entre otros documentos, la Laudato si’. |
