L’A. mentionne les droits reconnus au cours de l’enquête préliminaire conformément au Vademecum sur quelques points de procédure, et une brève mention est faite de la possibilité de recevoir une compensation pour les dommages. L’A. explore l’importance de la terminologie utilisée lorsqu’on se réfère aux victimes ou aux victimes présumées dans les procédures pénales. Enfin, l’article se conclut par quelques propositions qui permettraient aux victimes d’abus un véritable rétablissement de la justice, compte tenu des particularités du droit canonique et des droits de l’accusé qui doivent également être reconnus. | ||

The first part of this article addresses the current position of the alleged victim in canon law as a witness in penal proceedings and the problems that this role poses for alleged victims. The A. mentions the rights recognised during the preliminary investigation in accordance with the Vademecum on certain procedural issues, and a brief mention is made of the possibility of receiving compensation for damages. The A. explores the importance of the terminology used when referring to the victims or the alleged victims in penal proceedings. Finally, the article concludes with some proposals that would allow the victims of abuse a true restoration of justice, considering the particularities of canon law and the rights of the accused that must also be recognised. | ||
