| 总结: | Although the Universal Declaration of Human Rights consider the right of founding a family as an adults right, this article aims to defend the family asa fundamental right of children, as its considered in the Declaration of the Rights of the Child. For that purpose we present the understanding of family relationsas a basic need for the children, where this right is based on, and the different ways to protect it, in the national and international child protection practice,and the main lacks and contradictions in this right protection nowadays. Finally we conclude with some proposals. A pesar de que la Declaración Universal de Derechos Humanos recoge el derecho a formar una familia como un derecho de los adultos, este artículo pretende defender la familia como un derecho fundamental de los niños, tal y como se recogió posteriormente en la Declaración de Derechos del Niño. Para ello se exponen la concepción de las relaciones familiares como una necesidad básica en los niños, de la que deriva este derecho, y los diferentes modos de salvaguardarlo en la práctica de la protección de menores en el plano nacional e internacional, y se exploran las principales lagunas y contradicciones en la protección de este derecho en la actualidad. Finalmente, se lanzan algunas propuestas a modo de conclusión. |
