| Zusammenfassung: | Having the Jubilee of Mercy as a main reference, and facing the challenges posed by the Synod on the Family, this paper attempts to present the canonical solutions in case of failed marriages and the possible new ways that can be considered from the point of view of canon law. Regarding the marriage nullity cases, I expound the deficiencies I perceive in the current praxis, and regarding canonical dissolutions, the possibility of delving into the full meaning of sacramentality and consummation. From this, I propose to extend the canonical solutions in favor of the faith and the salus animarum. Teniendo como referencia fundamental el Jubileo de la misericordia, y ante los retos que plantea el Sínodo de la familia, este artículo pretende exponer las soluciones canónicas ante los fracasos matrimoniales y los posibles cauces novedosos que a nivel canónico se pueden plantear. En relación con las causas de nulidad, exponemos las deficiencias e inconvenientes que percibimos en la praxis actual, y en relación con las disoluciones canónicas, la posibilidad de profundizar en el sentido pleno de sacramentalidad y consumación y desde ahí ampliar las soluciones canónicas en favor de la fe y de la salus animarum. |
