| Resumo: | Per consentire l'escardinazione di un chierico in vista della sua incardinazione in altra Chiesa, il Codice latino delinea due "motivi giusti": l'utilità della Chiesa e il bene del chierico. Così facendo attribuisce all'escardinazione il valore di diritto soggettivo, che può essere rivendicato dal chierico e negato solo in presenza di causa grave. Cosa significano dunque utilitas Ecclesiae e bonum clerici? Perché siano cause giuste devono essere intese in senso giuridico, ovvero nel quadro della natura della Chiesa e dei diritti e obblighi del soggetto in quanto chierico e in quanto fedele. L'articolo approfondisce i due elementi alla luce dei diritti fondamentali. In order to permit the excardination of a cleric in view of his incardination in another Church, the Latin Code outlines two 'Just reasons": the usefulness for the Church and the good of the cleric. In doing so, it attributes to excardination the value of a subjective right, which can be claimed by the cleric and denied only in the presence of a serious cause. What, then, do utilitas Ecclesiae [usefulness for the Church] and bonum clerici [good of the cleric] mean? For them to be just causes they must be understood in a juridical sense, i.e. within the framework of the nature of the Church and of the rights and obligations pertaining to the subject as cleric and as faithful. The article examines the two elements in depth in the light of fundamental rights. |
