Resumo:Taking its cue from the growing invitation to generosity in forgiveness and from contemporary pastoral praxis, this article examines the coherence of the penitential judgment in the imparting of absolution. The absolutio concedenda, deneganda and differenda has been the object of wide-ranging and detailed discussion in modern canonical-sacramental doctrine, having been incoproated into both the code and subsequent interventions. The judicial nature of Reconciliation means that the minister adjudicate the requirements of the sacramental economy. The presumption of due repentance does not preclude the possibility that the confessor objectively determines that the subject lacks such a disposition, and thus may deny absolution. Since the lack of openness to grace may be due to an existential unyieldingness in the penitent, the denial of absolution may function as an encouraging invitation to mature in the conditions necessary to receive it. In accordance with the widespread guidance of the Magisterium, we foresee further refinement of the legal formulation so as to resolve the disparity between criteria applied by sacred ministers and the effectiveness of hierarchical oversight in entrusting the ministry of Confession.
