Dazu stellt er zunächst fest, dass jeder das Recht hat, seine Privatsphäre zu schützen. Ein Priester muss immer einer psychologischen Bewertung und der Zusendung der Ergebnisse an den Bischof zustimmen, bevor dies geschehen darf. Dennoch gibt es Situationen, in denen ein Bischof den Rat von Experten braucht, bevor er zum Beispiel einen Priester von der Dienstausübung gemäß can. 1041.1 befreit. Es muss eine bona fide-Basis geben, bevor der Bischof Experten hinzuziehen darf. Diese Basis kann aus einer Untersuchung nach can. 1717 als Ergebnis hervortreten. Aufgrund dieser Basis obliegt es dem Bischof, eine psychologische Bewertung anzuordnen, aber dennoch kann er den Priester nicht zwingen, mitzuarbeiten.
