Résumé: | The CIC gives a several solutions to solve the vices of nullity of the canonical marriage; one of them is to come to the procedure of confirmation of the marriage: the simple confirmation and the "sanatio in radice". The first epigraph studies the regulation of the simple confirmation in the CIC of 1917, when was foreseeing three hypotheses according to which the marriage was void for the existence of an annulling impediment, for a fault or vice, or fault of form. The current CIC supports substantially the same regulation. The second epigraph examines the institution of the "sanatio in radice", extraordinary way to confirm the marriage, in both legislations |
