En el primer caso se trata de la ausencia de suficiente uso de razón, sea esta permanente o transitoria. El apartado segundo hace referencia a la necesitaria discreción de juicio en orden al discernimiento de los derechos y deberes esenciales del matrimonio. En ambos casos es la adolescencia el momento en el que la ley considera que se ha alcanzado el nivel mínimo necesario para poder contraer un válido matrimonio (c. 1083,§1). En este artículo se desarrolla la tesis tomista en torno a la inseparabilidad de las facultades intelectivas y volitivas en el individuo aplicadas a los apartados primero y segundo del c. 1095. El estudio comprende no sólo el aspecto doctrinal sino también el jurisprudencial relativo a lo que ha venido en llamarse "importancia moral". The Code of '83 has grouped together in the first and second sections of c.1095 two forms of incapacity to make a valid consent to marriage. The first case deals with the absence of sufficient use of reason, be this permanent or passing. The second refers to the necessary descretion of judgement with regard to the discernment of the essential rights and duties of marriage. In both cases, the law considers that adolescence is the moment when people reach the minimum level needed to contract a valid marriage (c.1083,§1). The article develops the thomistic thesis regarding the inseparability in an individual of the faculties of understanding and volition, applied to the first and second sections of c.1095. The study takes in not only the doctrinal but also the jurisprudential aspect of what has come to be called "moral impotence" | ||
