| 520 | |a The Trust is an institution, typical of the English legal tradition. Studies frequently underline a contradiction with the founding principles of Civil Law legal systems. On the contrary, our analysis deals with the historical development of the Trust in order to affirm ist unequivocal relationship with Canon Law. Legal categories derived from Canon Law directly influence the definition of the Trustee's activities and contribute to an easier harmonization of the same with the Civil Law tradition. The Trust is characterized by the destination of the powrrs, associated with the property of the Trust fund, for the purposes intended by the settlor. This kind of power is actually a munus, a notion typical of Roman Law., which recently became the central concept in the legal System solution of the difficult question regarding the possibility of a "Trustee", i.e. of a "functional ownership", in Civil Law Systemns. We will be able to see, through the comparative analysis of this specific subject, that Canon Law can represent a "bridge" between the two great legal families, i.e., Common Law and Civil Law. | ||
