Der Beitrag beleuchtet die Kernpunkte der neuen päpstlichen Gesetzgebung und die Chancen, die sich daraus für die Pastoral an Geschiedenen Wiederverheirateten ergeben können. Dabei wird nicht verschwiegen, dass die neue Gesetzgebung rechtsdogmatisch nicht der ganz große Wurf geworden ist. Dazu enthält er, zumindest aus dem Blickwinkel einer deutschen juristisch-kanonistischen Methodik, zu viele Ungereimtheiten. Insgesamt jedoch wird die Gesetzesänderung als ein Fortschritt in der Rechtsentwicklung bewertet. Canon law faces all kinds of challenges in the pontificate of Pope Francis. The imperative here is to link mercy and law with each other in a new way. This has occurred in the area of marriage procedural law as a result of the desiderata of the Bishops' Synod of 2014. The article examines the core points of the new papal legislation and the opportunities which could emerge from this for pastoral ministry to remarried divorcees. That the new legislation has not been the really great masterstroke in terms of legal doctrine is not concealed here. It contains too many inconsistencies for this, at least from the perspective of a German juridical-canonistic methodology. But, on the whole, the change in the law is judged to be an advance in the legal developement. | ||
